GENERAL TERMS & CONDITIONS
By signing up to any of CuriousCore’s courses and programs, you agree to the following Terms & Conditions.
“Confidential Information” means any and all proprietary, technical, financial or business information, information relating to the UX industry, marketing information, employees, students and their records, intellectual property, business operations and structure, and any other information that would normally constitute confidential information and/or trade secrets, disclosed in any form, including but not limited to verbal, written, electronic or photographic form, of CuriousCore to which the Student may gain access during the term of this Agreement;
Confidential Information of CuriousCore shall also include all contents and materials relating to the Course
1 INDEMNITY
1.1 The Student shall indemnify and hold CuriousCore and its directors, employees and service providers harmless from and against all liabilities, losses, damages, costs and expenses (including reasonable legal fees) in relation to any claims or actions:
(a) brought or instituted by a third party against CuriousCore in relation to any acts or omissions, including those causing personal injury or death or property damage, arising out of or in connection with the Student’s participation in the Course and receipt of Services,
(b) brought or instituted by a third party and arising out of a breach by Student of its confidentiality obligations under this Agreement and
(c) arising out of a breach by Student of any Applicable Law.
1.2 The obligation of the Student to indemnify CuriousCore under this Agreement shall come into effect only if:
(a) CuriousCore gives prompt notice of the claim to the Student.
(b) CuriousCore allows the Student to take control of its defense and direct proceedings in all aspects including by appointment of lawyers.
(c) CuriousCore does not make any admission with respect to the claim or any settlement of the claim.
1.3 The Student shall not compromise or settle any claim or make any admission of liability on the part of CuriousCore without the consent of CuriousCore, unless such compromise or settlement has the effect of relieving the Indemnified Party from all claims made against it.
2 INTELLECTUAL PROPERTY
2.1 All ideas, methods, inventions and discoveries and such other work made or created by CuriousCore in the course of performing the Services and conducting the Course, and all materials provided by CuriousCore while performing Services shall remain the property of CuriousCore and all copyright and other intellectual property rights which may exist in any of such items shall belong to CuriousCore.
2.2 CuriousCore shall not be restricted from using such materials, ideas, methods, inventions, discoveries and other materials for the purpose of provision of similar or different services or conduct of a similar or different course, to any other person or entity.
2.3 Research papers, project papers and assignments completed by the Student shall be the property of the Student. CuriousCore shall however have a perpetual, royalty-free license to refer to and use such documents or materials, in whatever form, for marketing and advertising and as works of reference for other students and staff.
3 CONFIDENTIALITY
3.1 Subject to Clause 3.2 below, the Student shall ensure that all Confidential Information disclosed by CuriousCore to the Student under this Agreement or which may at any time during the Course or thereafter come into the Student’s knowledge, possession or control, shall not be used for any purpose other than for the objectives of the Course and the Student’s participation in the Course, and shall remain confidential and shall not be disclosed to any third party.
3.2 The provisions of Clause 3.1 shall not apply to any Confidential Information:
(a) which is disclosed to the Student by a third party under no obligations of confidentiality with respect to such information;
(b) which has become part of the public domain other than by reason of breach of this clause;
(c) which is independently developed by the Student without reliance on information provided by the Disclosing Party, as shown by written records;
(d) which was known by the Student prior to its receipt from CuriousCore, as shown by written records;
(e) which is required by any governmental entity, or any Applicable Law, to be disclosed.
PROVISIONAL CLAUSE FOR INTENSIVE COURSES
This refers to the UX Design Course (2-Day Intensive) and Product Management Course (1-Day Intensive).
By signing up for CuriousCore’s Intensive Courses, you understand that you are holding a spot and payment is strictly not refundable. If you are unable to attend, you understand that you can transfer your spot to someone else within one year from the course sign-up date.
PROVISIONAL CLAUSE FOR PROGRAMS
This refers to the 4-Month UX Career Accelerator and the Product Manager Course (CCP) (“Programs”). You will find the relevant Cancellation and Refund Policy below. Please refer to your copy of the Coaching Training Agreement for full details.
For Career Conversion Program (CCP), refunds will be calculated based on the module cost breakdown, instead of point 2 below. Please refer to the latest breakdown from your instructor.

CuriousCore reserves the right to cancel, postpone, or suspend the Course if the minimum required number of Students needed to economically and efficiently conduct the Course have not been enrolled in the Course within 5 days before the scheduled commencement date of the Course.

Course cancellation may be eligible for a prorated refund of Course Fees on remaining months where the Course has not been undertaken, less administrative fees. An administrative fee of $1,000 applies to cancellation of all Programs.
For example, if a student (enrolled in a Course from 01 Jun 2020 to 30 Sep 2020, paying Course Fees of $5,500) decides to leave the Course on 01 Jul 2020, the student may be refunded Course Fees equivalent to the period of 01 Aug 2020 to 30 Sep 2020 ($5,500/2=$2,750), less the administrative fee, which amounts to ($2,750-$1,000=) $1,750.
FORCE MAJEURE

CuriousCore shall not be liable to the Student for any postponement, suspension or cancellation of the Course for reasons beyond CuriousCore’s control such as, but not limited to, (a) an inadequate number of students enrolled in the Course, to be decided at CuriousCore’s sole discretion, (b) unavailability of instructors, trainers or teachers, or (c) other circumstances beyond the reasonable control of CuriousCore which shall include (but not be limited to) acts of God and natural calamities, terrorism, fire, explosion, riots or civil violence or commotion, acts of war or other military action and acts of civil authority.

All such events shall be considered force majeure events, and if any force majeure event continues for more than two calendar months, either Party may terminate this Agreement immediately by written notice. In such a case, CuriousCore shall refund, without any obligation to pay interest or compensation, any portion of the Course Fees in respect of which Services have not been provided to the Student.
GOVERNING LAW
These Terms of Use and your use of the Site and the Course Offerings are governed by and construed in accordance with the laws of the Republic of Singapore applicable to agreements made and to be entirely performed within the Republic of Singapore, without regard to its conflict of law principles.
